ABSTRACT
Resumo Introdução: a experiência relatada diz respeito às iniciativas desenvolvidas pelo Fórum Intersindical de Formação em Saúde-Trabalho-Direito para a Ação em Saúde do Trabalhador (ST), no Rio de Janeiro, no período de agosto de 2015 a outubro de 2017. O Fórum é um espaço de articulação entre instituições públicas e o movimento sindical cujas iniciativas compreendem reuniões ordinárias e extraordinárias, grupos de trabalho, boletim informativo, cursos de formação intersindical, seminários, encontros e oficinas. Objetivo: descrever a discutir a atuação do Fórum como instrumento de análise e consolidação da saúde do trabalhador. Métodos: organizado enquanto comunidade ampliada de pares, o Fórum foi analisado a partir de três vertentes: um estudo empírico sobre a percepção dos participantes, utilizando-se o método SWOT/FOFA, revisão bibliográfica e análise de documentos produzidos no seu âmbito. Resultados: evidenciaram-se obstáculos, avanços, desafios e resultados relacionados a sua dinâmica de funcionamento e contribuição à implementação da saúde do trabalhador. Conclusão: os resultados demonstraram a relevância e viabilidade do Fórum enquanto comunidade capaz de contribuir para a difusão e consolidação da área de saúde do trabalhador no Brasil.
Abstract Introduction: the reported experience concerns the initiatives developed by the Inter-union Training Forum on Health-Labor-Law for the Action in Occupational Health, in Rio de Janeiro, Brazil, from August 2015 to October 2017. The Forum is a space for articulation between public institutions and the trade union movement whose initiatives include ordinary and extraordinary meetings, working groups, newsletter, inter-union training courses, seminars, meetings and workshops. Objective: to describe and discuss the Forum's performance as an instrument for analysis and consolidation of worker's health. Methods: organized as an extended peer community, the Forum was analyzed from three dimensions: an empirical study on the participants' perception, using the Swot method, literature review and analysis of documents produced within it. Results: the authors evidenced obstacles, advances, challenges and results related to the Forum's operating dynamics and contribution to the implementation of worker's health. Conclusion: the results demonstrated the relevance and viability of the Forum as a community capable of contributing for the diffusion and consolidation of the worker's health area in Brazil.

RESUMO O texto, enquanto ensaio reflexivo, tem como objetivo analisar as normas operacionais e de pactuação do Sistema Único de Saúde (SUS), no sentido de observar se o enunciado normativo decorrente dos pactos em saúde é coerente com a determinação constitucional de promoção, proteção e reabilitação da saúde dos trabalhadores e com o enfrentamento dos alarmantes indicadores epidemiológicos dos agravos decorrentes do trabalho. Utiliza, como método, a análise documental e bibliográfica referente ao tema e conclui que, a partir das necessidades em saúde, aquelas que dizem respeito à saúde do trabalhador são desconsideradas pelos mecanismos de pactuação e gestão do SUS.
ABSTRACT This is a reflective essay that analyzes the Unified Health System's (SUS) operational and agreement rules. It shows that the normative statement resulting from health agreements is consistent with the constitutional provision of promotion, protection and rehabilitation of the worker's health and the epidemiological indicators of diseases resulting from work. It uses, as a method, the documentary and bibliographic analysis related to the subject and concludes that, based on the health needs, those that concern the worker's health are disregarded by the mechanisms of agreement and management of the health needs related to worker's health are disregarded by the pact mechanisms and management of the SUS.

Inscritas na Constituição Federal de 1988, as ações de Saúde do Trabalhador no Sistema Único de Saúde carecem de uma efetividade capaz de mudar os alarmantes indicadores epidemiológicos de acidentes e doenças do trabalho. Mesmo sendo reflexo da postura político-econômica dos governos pós-constitucionais, a gestão do Sistema Único de Saúde é determinante na omissão e, mesmo, ofensa ao que se estabelece constitucionalmente. O texto, de caráter ensaístico, baseou-se em dados atualizados da Previdência Social, e em documentos e artigos sobre o campo da Saúde do Trabalhador e da hermenêutica jurídica quanto à aplicabilidade das normas que regem as ações, especialmente de saúde pública, do Poder Executivo no Estado de Direito.
Enrolled in the Federal Constitution of 1988, the worker's health actions within the Unified Health System require effectiveness able to change the alarming epidemiological indicators of accidents and work-related diseases. Even being reflection of the political-economic posture of post-constitutional governments, Unified Health System is decisive in the omission and, likewise, in the offense to what is established constitutionally. This text, of essayistic character, was based on updated data from the Social Security, and on documents and articles about the worker's health field and legal hermeneutics regarding to the applicability of the rules that govern the actions, especially of public health, of the executive power in the Law's State.
